RENTAL TERMS & CONDITIONS

These Rental Terms & Conditions (“Terms”) apply to the rental of vehicles and related equipment by Just 4X4 SA (Pty) Ltd (“Just 4X4 SA”, “we”, “us” or “the Company”) to the person or persons named in the Rental Agreement (“the Renter”, “you” or “your”).

By signing or electronically accepting the Rental Agreement, you confirm that you have read, understood and accepted these Terms. Electronic acceptance may form part of the rental agreement where permitted by applicable law.


1. DEFINITIONS

1.1 “Agreement”

Means these Terms together with the quotation, booking confirmation, Rental Agreement, vehicle condition report and any other documents expressly incorporated into the rental.

1.2 “Company”

Means Just 4X4 SA (Pty) Ltd.

1.3 “Renter”

Means the person named on the Rental Agreement as the renter and includes any authorised driver where applicable.

1.4 “Vehicle”

Means the vehicle specified in the Rental Agreement, together with its keys, tyres, spare equipment, accessories, tools, documents and camping equipment supplied with the vehicle.

1.5 “Rental Period”

Means the period beginning when the Vehicle is collected or delivered to the Renter and ending when it is returned to and accepted by the Company.

1.6 “Rental Agreement”

Means the booking or rental document issued by Just 4X4 SA and accepted by the Renter.

1.7 “Additional Driver”

Means a person who has been approved by the Company and recorded on the Rental Agreement as an authorised driver.

1.8 “Damage Liability / Excess”

Means the amount for which the Renter remains responsible following damage, theft or loss, subject to the applicable protection or insurance arrangements stated in the Rental Agreement.

1.9 “Security Deposit”

Means the amount authorised, charged or held by the Company as security for amounts that may become payable during or after the Rental Period.


2. RENTAL

2.1 The Company agrees to rent the Vehicle to the Renter for the Rental Period stated in the Rental Agreement.

2.2 The Vehicle is supplied together with the equipment and accessories recorded on the vehicle handover or equipment checklist.

2.3 The Renter must inspect the Vehicle and equipment before departure and must ensure that any existing damage is recorded.

2.4 Any extension of the Rental Period must be approved by the Company in advance and may be subject to additional charges.

2.5 The Company may terminate the rental if the Renter breaches these Terms, uses the Vehicle unlawfully, places the Vehicle at unreasonable risk, or fails to make required payments.


3. RESERVATION AND PAYMENT

3.1 A reservation is confirmed only once the Company has received the required deposit or payment stated in the quotation.

3.2 The payment structure applicable to each rental will be stated in the quotation or booking confirmation.

3.3 Unless otherwise agreed in writing, the outstanding rental balance must be paid before Vehicle collection.

3.4 Bookings made shortly before the collection date may require full payment at the time of booking.

3.5 All applicable taxes, rental charges, delivery charges, optional equipment charges and other agreed fees are payable by the Renter.

3.6 The Company may cancel a reservation where required payments are not received within the applicable payment period.


4. RENTAL CHARGES

4.1 The Renter is responsible for all amounts stated in the quotation and Rental Agreement.

4.2 Additional charges may apply for:

  • Additional drivers
  • Optional equipment
  • Delivery or collection outside agreed arrangements
  • Cross-border travel
  • Traffic fines
  • Tolls
  • Fuel
  • Cleaning
  • Loss or damage
  • Recovery or towing
  • Lost keys
  • Unauthorised use
  • Late return
  • Administrative services

4.3 Any charge arising from the Renter’s use or possession of the Vehicle may be charged to the payment method authorised by the Renter, subject to applicable law.


5. SECURITY DEPOSIT

5.1 The Company may require a security deposit before releasing the Vehicle.

5.2 The deposit may be used to settle amounts properly payable under the Agreement, including damage, missing equipment, traffic fines, fuel, cleaning, recovery and other outstanding charges.

5.3 The balance of the deposit will be released or refunded after the Vehicle has been returned and all applicable charges have been assessed, subject to banking and payment-provider processing times.

5.4 The precise deposit amount and release conditions will be stated in the quotation or Rental Agreement.


6. VEHICLE AVAILABILITY

6.1 All reservations are subject to Vehicle availability.

6.2 Where the reserved Vehicle becomes unavailable due to circumstances beyond the Company’s reasonable control, the Company may offer a suitable alternative vehicle.

6.3 Vehicle photographs are illustrative and may not always represent the exact Vehicle supplied.


7. RENTER’S RESPONSIBILITIES

The Renter must:

7.1 Take reasonable care of the Vehicle.

7.2 Check oil, coolant, tyre pressure, fuel and other basic vehicle requirements where applicable.

7.3 Use the correct fuel.

7.4 Keep the Vehicle secure whenever unattended.

7.5 Keep the keys in a secure place.

7.6 Comply with all road traffic laws and applicable regulations.

7.7 Observe road, weather, terrain and vehicle restrictions.

7.8 Immediately notify the Company of any accident, theft, breakdown, warning light or significant damage.

7.9 Return the Vehicle, equipment and accessories in substantially the condition in which they were supplied, fair wear and tear excepted.


8. PROHIBITED USE

The Vehicle may not be:

8.1 Used for unlawful purposes.

8.2 Used for racing, speed testing or motor sport.

8.3 Used to carry passengers or goods for payment without the Company’s written consent.

8.4 Used to tow another vehicle, trailer or caravan unless expressly authorised.

8.5 Driven by an unauthorised driver.

8.6 Driven while the driver is under the influence of alcohol, drugs or any substance that impairs driving ability.

8.7 Used in a manner that risks overloading, damage or abnormal wear.

8.8 Taken onto restricted routes, private property or prohibited areas without permission.


9. AUTHORISED DRIVERS

9.1 Only drivers approved and recorded in the Rental Agreement may drive the Vehicle.

9.2 Every driver must hold a valid driver’s licence appropriate for the Vehicle.

9.3 International visitors must carry the documentation legally required for driving in South Africa.

9.4 The Company’s minimum driver age and licence-history requirements will be stated in the quotation or Rental Agreement and must be satisfied before collection.

9.5 The Company may refuse delivery if the Renter cannot produce acceptable original identification and driving documents.


10. PICK-UP AND HANDOVER

10.1 The Renter must arrive at the agreed collection time with all required documents and payment instruments.

10.2 Before departure, the Company and Renter should complete an inspection of the Vehicle and record existing damage.

10.3 By accepting the Vehicle without recording an item of visible damage, the Renter may be taken to have accepted the Vehicle’s condition, subject to applicable law and any later-discovered latent defect.

10.4 The Renter should raise any mechanical or operational concern with the Company as soon as reasonably possible.


11. TERRITORIES AND CROSS-BORDER TRAVEL

11.1 The Vehicle may only be driven within territories approved by the Company.

11.2 Travel outside South Africa requires prior written approval from Just 4X4 SA.

11.3 Cross-border travel may require additional documentation, permits, fees, insurance arrangements and authorisations.

11.4 The Renter is responsible for complying with immigration, customs, road traffic and vehicle-entry requirements in every country visited.

11.5 The Company may impose route restrictions based on road conditions, weather, security conditions, political instability or other reasonable safety concerns.


12. RENTAL CANCELLATION

12.1 Cancellation charges will be determined by the cancellation terms stated in the quotation or booking confirmation.

12.2 Where no specific cancellation schedule is stated, the Company may apply the following default schedule:

  • More than 30 days before collection: refund less any non-refundable transaction or administration charges.
  • 15–30 days before collection: 50% of the total booking value.
  • Less than 15 days before collection or a no-show: 100% of the applicable booking value.

12.3 Special-event, peak-season and group bookings may have different cancellation conditions, which will be stated at booking.

12.4 Early return does not automatically entitle the Renter to a refund for unused rental days.


13. VEHICLE RETURNS

13.1 The Vehicle must be returned on the date, time and location specified in the Rental Agreement.

13.2 Late returns may result in additional rental charges.

13.3 Early returns do not automatically result in a refund.

13.4 The Vehicle must be returned with the agreed fuel level.

13.5 The Vehicle and supplied equipment must be returned reasonably clean.

13.6 Excessive cleaning, smoke odour, stains, damage or missing equipment may result in additional charges.

13.7 All keys, accessories, camping equipment, recovery equipment and other supplied items must be returned.


14. DAMAGE, LOSS AND LIABILITY

14.1 The Renter is responsible for loss or damage occurring during the Rental Period, subject to the applicable damage protection, insurance or liability arrangements.

14.2 The Renter remains responsible for damage resulting from prohibited use, negligence, reckless conduct, unauthorised driving, breach of these Terms or circumstances excluded from the applicable protection.

14.3 Damage to tyres, rims, glass, undercarriage, roof-mounted equipment, camping equipment or accessories may be subject to separate liability according to the Rental Agreement.

14.4 The Renter must not arrange unauthorised repairs or towing without contacting the Company, except where immediate action is reasonably necessary to protect life or prevent further material damage.


15. DAMAGE PROTECTION / INSURANCE

15.1 Any damage protection, insurance option or excess applicable to the rental will be stated in the quotation or Rental Agreement.

15.2 Damage protection is subject to exclusions.

15.3 Protection may not apply where the Renter has breached the Agreement, driven recklessly, used an unauthorised driver, driven under the influence, travelled without approval or otherwise acted outside the permitted use of the Vehicle.

15.4 The Renter remains responsible for the applicable excess or other liability expressly stated in the Rental Agreement.


16. ACCIDENT, THEFT OR BREAKDOWN

In the event of an accident, theft, attempted theft or significant damage, the Renter must:

16.1 Take reasonable steps to protect people and secure the Vehicle.

16.2 Notify the appropriate police or emergency authorities where required.

16.3 Notify Just 4X4 SA as soon as reasonably possible.

16.4 Obtain details of other drivers and witnesses where applicable.

16.5 Not admit liability or settle third-party claims without the Company’s approval.

16.6 Provide the Company with a police case number or other relevant documentation where applicable.

16.7 Cooperate with the Company’s investigation and insurer.


17. VEHICLE REPAIRS

17.1 Minor emergency repairs may be undertaken where reasonably necessary to keep the Vehicle safe and mobile.

17.2 The Renter should obtain prior approval from the Company before incurring repair expenses.

17.3 Reimbursement may require original receipts and proof that the expense was reasonably necessary.

17.4 Unauthorised expenditure may not be reimbursed.


18. TYRES AND OFF-ROAD USE

18.1 The Renter is responsible for operating the Vehicle responsibly according to road, tyre and terrain conditions.

18.2 Punctures or tyre damage caused by misuse, inappropriate speed, impact or driving conditions may be for the Renter’s account, subject to the Rental Agreement.

18.3 The Renter must not intentionally undertake hazardous off-road driving, dune driving, river crossings or other extreme activities unless expressly authorised.

18.4 The Vehicle must only be used on roads and tracks approved by Just 4X4 SA.


19. TRAFFIC FINES, TOLLS AND INFRINGEMENTS

19.1 The Renter is responsible for all traffic fines, tolls, parking charges and other road-related penalties incurred during the Rental Period.

19.2 The Company may charge a reasonable administration fee where it is required to process or redirect a fine or infringement.


20. VEHICLE TRACKING AND SECURITY

20.1 The Company may use vehicle tracking or security technology for legitimate fleet-management, security, recovery and operational purposes.

20.2 Tracking information will be handled in accordance with the Company’s Privacy Policy and applicable South African law.


21. UNLIMITED KILOMETRES / FAIR USE

21.1 Where unlimited kilometres are included in the rental, the benefit is subject to reasonable and responsible use.

21.2 The Company reserves the right to address usage that is objectively excessive, abusive or inconsistent with the normal purpose of the rental, subject to the terms communicated to the Renter before or during the rental.


22. FORCE MAJEURE

22.1 The Company will not be responsible for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, severe weather, government restrictions, civil unrest, road closures, war, strikes, epidemics or other extraordinary events.

22.2 Nothing in this clause excludes rights that cannot lawfully be excluded under South African law.


23. PERSONAL INFORMATION

23.1 Just 4X4 SA will process personal information in accordance with its Privacy Policy and applicable South African data-protection laws.

23.2 Personal information may be processed for bookings, customer service, payments, vehicle security, legal compliance, fraud prevention and related business purposes.

23.3 The Company’s Privacy Policy explains the Renter’s rights and how personal information is handled.

POPIA is the relevant South African framework governing the processing of personal information, so this clause should be checked against the Company’s final Privacy Policy before publication.


24. ELECTRONIC ACCEPTANCE

24.1 The Renter may accept the Rental Agreement electronically where the Company provides that option.

24.2 Electronic acceptance is intended to record the Renter’s agreement to the applicable booking and rental terms, subject to applicable law. The ECT Act provides South Africa’s legal framework for electronic communications and transactions.


25. LIMITATION OF LIABILITY

25.1 Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.

25.2 Subject to applicable law, the Company will not be responsible for indirect or consequential loss arising from circumstances outside its reasonable control.

25.3 Nothing in these Terms is intended to remove any mandatory consumer right provided by South African law.

The Consumer Protection Act specifically provides a framework for fair consumer transactions and consumer agreements, so any final limitation-of-liability wording should be reviewed by a South African legal professional.


26. GENERAL

26.1 These Terms, together with the Rental Agreement and applicable quotation, constitute the agreement between the parties in relation to the rental.

26.2 If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

26.3 Any amendment to a confirmed rental must be agreed by the Company in writing.

26.4 The Renter may not transfer the rental agreement to another person without the Company’s prior written approval.


27. GOVERNING LAW

27.1 These Terms are governed by the laws of the Republic of South Africa.

27.2 Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate courts or statutory dispute-resolution bodies.
